1. Agreement and eligibility
By downloading, accessing, purchasing through, or using Niyah, you agree to these Terms of Service (“Terms”) and acknowledge our Privacy Policy. If you do not agree, do not use Niyah. “Niyah,” the “Service,” “we,” and “us” refer to the Niyah mobile application, website, and related services operated by Niyah Labs.
You must be legally capable of entering this agreement where you live. If you are not, a parent or legal guardian must review and accept these Terms for you and supervise your use. The Service is not directed to children under 13. If you use Niyah for another person, you confirm you have authority to accept these Terms on their behalf.
2. What Niyah provides
Niyah is a personal faith and wellbeing companion. Depending on platform, version, permissions, and purchase status, features may include local prayer times, prayer check-ins, hydration logs and goals, progress history, streaks and insights, reminders, widgets, themes, custom water amounts, progress-card sharing, Bubbi character personalization, and banner advertising in the free tier.
Advertising in the free tier
Niyah’s free tier shows banner ads delivered by Google AdMob and its advertising partners. Ads may be personalized, non-personalized, or limited according to your region, consent, device settings, and the configuration described in our Privacy Policy. Advertising content is supplied by third parties, may change without notice, and may link outside Niyah. An ad is not an endorsement by Niyah Labs. You are responsible for reviewing an advertiser’s identity, terms, privacy practices, claims, and offer before interacting or transacting with it.
No account is required. Most routine data is stored only on your device. You are responsible for maintaining your device, backups, connectivity, and compatible operating-system version. Data may be lost if you clear storage, uninstall Niyah, lose or replace your device, or a device database is damaged. We do not promise cloud backup, cross-device sync, or recovery of local history.
We may improve, add, remove, limit, or discontinue free features and may release different features by platform or region. We will not knowingly deprive you of a paid entitlement contrary to the description presented at purchase or applicable law. The Service may be unavailable during updates, outages, or circumstances outside our control.
3. Important religious, health, and safety guidance
Prayer times and religious information
Prayer times are calculated from your location by a third-party service. Results can differ based on calculation method, coordinates, time zone, device clock, data quality, school of thought, season, and the mosque or religious authority you follow. Niyah does not provide fatwas or religious rulings. Verify times—especially fasting start and end times and congregational prayer times—with a trusted local mosque or authority. You remain responsible for your religious practice and decisions.
Hydration and wellness
Water goals, checkpoints, trends, reminders, and streaks are general organizational and wellness tools. They are not medical advice, diagnosis, monitoring, or treatment and are not a medical device. Hydration needs vary. Seek qualified medical advice if you have a health condition, are pregnant or breastfeeding, take medication, exercise intensely, work in extreme conditions, or have been told to restrict fluids. During Ramadan or any fast, follow appropriate religious and medical guidance and do not use Niyah as a substitute for it. In an emergency, contact local emergency services.
Notifications and widgets
Notifications, countdowns, and widgets can be delayed, duplicated, suppressed, or inaccurate because of device settings, battery optimization, connectivity, operating-system behavior, clock changes, or software errors. Do not rely on Niyah as your only reminder or for any safety-critical purpose.
4. Purchases, subscriptions, and refunds
Niyah may offer (a) Niyah+ on a monthly or annual auto-renewing subscription and (b) a one-time supporter purchase for permanent ad-free access. Niyah+ may include premium personalization, adaptive reminders, insights, themes, widgets, custom water amounts, and ad-free access. The exact product, features, localized price, currency, billing period, taxes, and any trial or promotion are shown in the App before you confirm a purchase and control over any general description on the Site.
Apple or Google—not Niyah Labs—processes your payment. An auto-renewing subscription renews and your store account is charged unless you cancel through that store’s subscription settings at least as required by the store before the current period ends. Deleting the App does not cancel a subscription. Cancellation stops future renewal but generally does not end access before the paid period expires.
Restore Purchases can recover eligible entitlements using the same store account. Restoration across Apple and Google ecosystems is not guaranteed. The one-time supporter purchase removes advertising displayed by Niyah in the App; it does not include Niyah+ features unless expressly stated at purchase and does not remove advertising from third-party pages or services you open. Active Niyah+ access includes ad-free access while the subscription remains active. A short validation delay or store outage may temporarily prevent an ad-free entitlement from being recognized. Store rules and applicable law govern billing, family sharing, refunds, chargebacks, price changes, and taxes. Except where law requires otherwise, refund requests must be made to the store that processed the transaction.
We use RevenueCat to validate and restore entitlements. Attempting to manipulate receipts, bypass payment, or obtain paid access fraudulently violates these Terms. If a purchase is refunded, revoked, expires, or cannot be validated, the associated entitlement may be removed.
5. The Niyah clean-water pledge
Niyah pledges to donate a portion of its proceeds to organizations and initiatives working to improve access to clean water. Donation amounts, timing, recipients, and supported projects may vary. Completed donations will be listed on the Impact page with the recipient, amount, date, purpose, and available proof.
An in-app payment purchases digital access to Niyah; it is not a charitable donation by the purchaser, does not guarantee that a particular amount from that purchase will be donated, is not tax-deductible for the purchaser, and does not entitle the purchaser to a donation receipt. Niyah chooses the recipients and may update or discontinue this pledge prospectively.
6. License, content, and acceptable use
Subject to these Terms and applicable store rules, Niyah Labs grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices you own or control for personal, non-commercial use. You do not acquire ownership of Niyah, its software, visual design, characters, text, branding, or other content.
You agree not to:
- use Niyah unlawfully, abusively, deceptively, or in a way that harms another person;
- interfere with security, integrity, availability, purchase validation, or other users’ access;
- reverse engineer, decompile, scrape, copy, resell, or create derivative works except where law expressly permits it;
- introduce malware, probe systems without authorization, or access data or services you are not permitted to access; or
- misrepresent an affiliation with Niyah Labs or use our marks without permission.
You retain rights in the display name, routine entries, and other information you enter. When you choose to generate and share a progress card, you authorize Niyah to process that content on your device for the requested share and are responsible for where and with whom you share it. If you send feedback, you grant us a worldwide, perpetual, royalty-free right to use it without identifying you or owing compensation.
7. Third parties, disclaimers, and liability
Niyah relies on services and platforms provided by AlAdhan, RevenueCat, Apple, Google, Google AdMob and its advertising partners, Vercel, your device manufacturer, and services you choose through the share sheet. Their services and your use of them are governed by their terms and privacy practices. We are not responsible for third-party content, advertisements, advertiser offers or transactions, availability, calculations, payment decisions, or conduct.
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Niyah Labs disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that prayer times, reminders, goals, insights, or other outputs will always be complete or accurate.
To the maximum extent permitted by law, Niyah Labs and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, opportunity, profits, or religious or health outcomes arising from Niyah. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid to Niyah Labs through the applicable app store in the 12 months before the event giving rise to the claim or CAD $30. These exclusions do not apply where prohibited, and nothing in these Terms limits non-waivable consumer rights or liability that cannot legally be excluded.
We may suspend access to paid or online features for fraud, abuse, security risk, or material breach of these Terms. Provisions that by nature should survive—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—survive termination.
8. Additional terms for Apple users
If you obtained the App from Apple, these Terms are between you and Niyah Labs, not Apple. Niyah Labs, not Apple, is responsible for the App, its content, maintenance, support, warranties, product claims, legal compliance, and intellectual-property claims. Apple has no obligation to provide maintenance or support. Your license is limited to use on Apple-branded products you own or control as permitted by Apple’s Usage Rules, including applicable Family Sharing rules.
If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price for the App, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. You represent that you are not in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not on a U.S. Government prohibited or restricted-party list. You must comply with applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Changes, law, and contact
We may update these Terms prospectively. We will post the revised Terms and date and provide any notice or obtain any consent required by law. Material changes do not retroactively change your rights to a completed purchase. Continued use after revised Terms take effect means you accept them, except where law requires another form of consent.
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Courts located in Toronto, Ontario have exclusive jurisdiction, unless mandatory consumer law permits you to bring a claim elsewhere. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. These Terms and the Privacy Policy are the entire agreement concerning the Service, and a failure to enforce a provision is not a waiver.
